DEADLINE APPROACHING FOR
PAYMENT ADJUSTMENT HARDSHIP EXCEPTION RECONSIDERATION.
If you are subject to Medicare Payment Adjustments in 2017 (your Medicare reimbursement rates were reduced beginning 1/1/2017) because you either didn’t attest to meaningful use, or your attestation didn’t meet minimum requirements, there may be a way for you to have that penalty modified.
To avoid payment adjustments a provider must either demonstrate meaningful use in the Medicare EHR Incentive Program or submit an application for a hardship exception explaining why they should be excused from this penalty. If you want to explore whether you can/should file for a Payment Adjustment Hardship Exception Reconsideration, here’s what you need to do:
1) Determine if you were subject to the 2017 payment adjustment. You should have received a letter from Medicare indicating the reduction in payment beginning 1/1/2017. If your rates didn’t go down, stop here, the exception doesn’t apply to you.
2) Use Chart 1 below, to see if there are reasons why qualify for the hardship exception. This table is taken from the hardship exception application. Neither DB Consultants nor Havenridge Consulting can tell if your reason will meet Medicare requirements. If you have questions, we encourage you to contact Medicare directly.
3) If you think you have a qualifying reason why you couldn’t meet EHR participation, then go to Chart 2. Be sure you know that this is about your demonstration of meaningful use in 2015, your attestation in 2016, and your payment adjustment in 2017. If so, then print the overview, instructions and application. Review to confirm that this does apply to you. 4) After completing the form, it must be submitted by February 28, 2017. Medicare wants your application by email. If email isn’t available, then fax is acceptable. Instructions for this appear on Page 6 of the application.
Although we’d like to be able to offer advice about this process, Medicare is the final adjudicator on this. We advise that you contact them directly with any questions.
Eligible Professional (EP) Reconsideration Form
The deadline for Eligible Professionals to submit Reconsideration forms for the 2017 payment adjustment, based on the 2015 EHR reporting period is February 28th, 2017.
